Terms and Conditions: 

Samples: All samples are sold as Retail Purchases at the per item retail purchase price. There are no exceptions.

Purchases:

All purchases full container load whichever 20 or 40 feet.

Sales are FOB port of embarkation. Payment by confirmed Letter of Credit at the
time your order is accepted, drawn on international banks acceptable to the seller and Nestia Trading.  

All shipping costs from the port of embarkation are for the buyer's account.

Note On Wire Transfers: 

Nestia Trading will not ship unless and until Nestia Trading has received by fax a copy of the bank instructions from buyer's bank to Nestia Trading's bank that actually makes the wire transfer. (This is usually completed by a SWIFT or fed wire.) Such notice is the only way in which Nestia Trading can trace wayward wire transfers.  

A copy of buyer's instructions to buyer's own bank ordering a wire transfer is not sufficient. As the buyer, you must make special and specific request to your own bank to obtain a photocopy of the SWIFT or fed wire sent by your bank to Nestia Trading's bank, and then fax a copy of that document to Nestia Trading. 

If you elect to pay by making a wire transfer or direct deposit, sometimes called T/T, upon receipt and approval of your order, Nestia Trading will send to you a confirmation and an invoice with wire instructions.  

No order will be processed until Nestia Trading has received a copy of YOUR BANK's wire instructions to Nestia Trading's bank, and confirmation from our bank that your funds have been received.

Please note: we do not ask for, we do not want, and we will not accept your own request to your own bank for a wire transfer.  

Suspension of all work in progress will occur in the event we do not timely receive Notice of Payment or Actual Payment.

Unless otherwise stated on the page in question, purchases of full container loads (FCL) in either 20 foot or 40 foot containers qualify for  Purchase treatment. 

Prices when quoted are FOB port of embarkation with the following presumptions: (i) 20 or 40 foot container shipment for sea delivery to Port of Destination -- at buyer's cost; (ii) no extra packing; (iii) excluding arrival customs duty if any; and (iv) full payment by confirmed Letter of Credit (L/C) on international banks acceptable to seller and Nestia Trading. 

Export Provisions.

There are export duties and restrictions imposed on certain products.

On items sold FOB Port of Durban or Cape Town , if the price does NOT include all standard export license fees, such fees will be for your account and we will advise you.

 Insurance is extra.

 Obtaining and paying for insurance will be for the buyer's account as  sales here are FOB only. If Nestia Trading is hired and requested to obtain insurance, the full insurance fee must be paid at the time of order. 

Additional Terms.

All sales are final, no returns or credit is available.

There are no warranties or guarantees, express or implied, whether of fitness for a particular purpose, of merchantability, or otherwise. All warranties or guarantees that may be implied by law, custom, or usage are expressly disclaimed.

In those locations where disclaimers of liability are illegal, the foregoing disclaimer is inoperative.

Unless the seller agrees otherwise in an executed writing prior to delivery, prices are F.O.B. Port of embarkation ( Durban, or Cape Town). That means your purchase price includes the cost at the seller's risk for getting your purchased goods to the Port and on board a ship or aircraft. The Purchase Price does NOT include the costs for shipping, insurance, and/or handling.

The risk of loss or damage is yours at the time the goods are placed on board an international carrier.

The terms and conditions contained in this document may not be changed or varied absent a writing signed by both parties. No attempted change or variation not signed by Nestia Trading will bind Nestia Trading to that change or variation.

Shipping & Delivery

Shipping charges are in addition the purchase price, and include all standard matters (delivery from factory to port, warehousing, stevedore, loading, insurance and freight to your port of destination). We will make shipping arrangements here for you at NO cost, or you may make them yourself. 

Sea shipments require from 45 to 90 days for delivery from Port Durban or Cape Town, to your port of entry. 

You are responsible for all customs duty, stevedore, demurrage, warehousing, pick-up, and delivery charges originating from your port of entry.

Sales are FOB port of embarkation. Shipping costs are therefore for buyer's account alone.   Nestia Trading if requested will locate and coordinate with a local shipper. Our fees for this service are usually free except in certain special cases.

Shipments by air or sea freight cannot be made to a Post Office Box, Drop, or Room. Your full street address is required.

Shipping charges are in addition the purchase price, and include all standard matters after delivery from factory to Port. Shipping charges include by way of example but not limitation: warehousing, stevedore, loading, insurance and freight to your port of destination, and all charges after arrival at your port.

Unless you specify and agree to pay for Air Delivery, all shipments are by sea.

Sea shipments require from 30 to 90 days for delivery from Durban or Cape Town port to your port of entry. You are responsible for customs duty, stevedore, demurrage, warehousing, pick-up, and delivery charges from your port of entry.

Shipping Charges are never discounted.

All sea shipping charges cover port to port delivery only. You are responsible for the storage and collection of your shipment when it arrives at your designated port of destination. Air Freight can be door to door delivery.

Nestia Trading accepts no responsibility for shipping unless you have both retained and paid Nestia Trading for coordinating these tasks.
